Announcement Regarding the New Law of Hungary on the Issuance and Extension of Residence Permits for Third-Country Nationals (Vietnamese Workers)
The temporary residence permit for workers in Hungary will be valid for 18 to 24 months (2 years) and can only be extended once for a maximum period of 1 year. Thus, workers are allowed to live and work in Hungary for a maximum of 2 + 1 = 3 years.
Workers cannot apply within Hungary to change the purpose of their residence. If they wish to change their residence purpose, they must submit the application at the consulate outside Hungary.
Workers cannot change their residence status to family reunification purposes (for example: marrying, bringing close relatives with Hungarian nationality, etc.).
Workers are not allowed to apply for permanent residency.
When extending a residence permit, workers can only stay for the duration of the extension or the period allowed by the immigration authority’s decision. This means that if the worker receives a rejection of the extension application, the appeals process through the lower court, appellate court, and the supreme court will no longer extend the time as before. When the time stated in the application expires (maximum 1 year), the worker must return to their home country.
When a worker changes their employer, the residence permit change application will be treated as an extension of the permit. This means that it will only be valid for 1 year from the time the new residence permit is issued.
The processing time for issuing or extending the residence permit will be within 60 days.
When applying for a residence permit, the approval of the competent authority for a work permit is required. If no approval is needed from the relevant authority, educational or professional qualifications must be provided.
